These Terms of Service ("Terms") govern your use of MacroSight, an iOS/iPadOS/Mac Catalyst/watchOS nutrition and macro tracking application (the "App") made available by its developer ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Acceptance of terms
You must accept these Terms before using the App. On first launch (or after a material update to these Terms), the App presents a summary of the key points and requires an affirmative tap to continue. Continuing to use the App after that point constitutes acceptance. If you do not accept, the App will not proceed past the acceptance screen.
2. License grant
Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices you own or control, for your own personal, non-commercial use. This license does not grant you any right to the App's source code, and you may not reverse-engineer, decompile, redistribute, sublicense, or resell the App except as permitted by applicable law or Apple's App Store terms.
3. Not medical advice
MacroSight is an informational and educational tool. It is not a medical device and does not provide medical advice. Nutrient estimates — whether entered manually, looked up from a food database, scanned from a label, or generated by AI from a photo or description — are approximations and may contain errors. They are provided for general awareness of your eating habits only.
Do not rely on MacroSight's estimates for any medical decision. This includes, without limitation: calculating or adjusting insulin dosing or any other medication dosing; avoiding allergens or ingredients that could cause a medical reaction; managing a diagnosed medical condition (diabetes, kidney disease, PKU, celiac disease, food allergies, eating disorders, or any other condition); or any decision where an inaccurate nutrient value could put your health or safety at risk. Always verify critical values (especially allergens, sodium, sugar, and carbohydrate counts for medical dosing) directly against the physical product label or packaging, and consult a physician, registered dietitian, or other qualified professional for medical or dietary decisions.
The calorie and macro "targets" the App suggests during setup (via the Mifflin–St Jeor equation and related formulas) are general educational estimates, not a personalized medical or dietary prescription.
4. AI-generated content may be inaccurate
Features such as "AI Estimate" and label scanning use third-party or on-device AI models to interpret photos, text, or barcodes and produce nutrient estimates. AI-generated output can be incomplete, outdated, or simply wrong — it may misidentify a food, miss an ingredient, or produce a plausible-looking number that does not match reality. Always review AI-generated results before saving them, and verify anything safety-critical (allergens, medical dosing) against the original label or source.
5. Bring-your-own API key
Certain AI features require you to supply your own API key for a third-party AI provider (currently Anthropic's Claude API or xAI's Grok API, selectable in Settings). If you choose to use this feature:
- You are solely responsible for creating, funding, and maintaining your account with that provider.
- You are solely responsible for all costs, usage charges, or fees billed by that provider as a result of your use of the App.
- Your key is stored locally in the iOS Keychain (and synced via end-to-end-encrypted iCloud Keychain if you use multiple devices) — we never see it and cannot recover it for you if lost.
- Your use of the third-party provider is subject to that provider's own terms of service and acceptable-use policy, in addition to these Terms.
You may alternatively use Apple's on-device Foundation Models (Apple Intelligence) where available, which does not require an API key and does not send data to a third-party AI provider.
6. Third-party services
The App integrates with the following third-party services, each governed by its own terms and privacy policy:
- Anthropic (Claude API) and xAI (Grok API) — optional, user-key-based AI food/label estimation.
- USDA FoodData Central — public food and nutrient database, accessed via our proxy.
- Open Food Facts — community-maintained barcode/product database, used as a fallback.
- Apple HealthKit and iCloud (CloudKit / Key-Value Storage) — used, with your permission, to read/write health data and to sync your food log across your own devices.
We do not control these services and are not responsible for their availability, accuracy, or content.
7. Data accuracy disclaimer
Nutrition data drawn from USDA FoodData Central, Open Food Facts, manufacturer labels, OCR/label scanning, or AI estimation may be incomplete, outdated, or incorrect. Serving sizes, brand formulations, and packaging change over time. You are responsible for reviewing and verifying any value before relying on it, particularly for allergen and medical-dosing purposes as described in Section 3.
8. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY NUTRIENT VALUE, AI ESTIMATE, OR CALCULATION WILL BE ACCURATE OR COMPLETE.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR HEALTH-RELATED HARM, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) FIFTY US DOLLARS (US$50).
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless the developer of MacroSight from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: your use of the App; your violation of these Terms; your reliance on any nutrient estimate, AI-generated content, or calculated target for a medical decision; or your violation of any third-party AI provider's or data provider's terms in connection with your use of the App.
11. Changes to these terms
We may update these Terms from time to time. If a change is material, we will bump the "Effective date" above and require you to re-accept the Terms in-app before continuing to use the App (the same acceptance gate shown on first launch). Continued use after a non-material update constitutes acceptance of the revised Terms.
12. Termination
You may stop using the App and delete it at any time. We may suspend or discontinue the App, or any feature of it (including third-party integrations outside our control), at any time without notice. Sections that by their nature should survive termination — including Sections 3–11 — will survive.
13. Governing law
These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the App will be subject to the exclusive jurisdiction of the state and federal courts located in New York, USA, except where applicable law (including mandatory consumer-protection law in your jurisdiction) provides otherwise.
